Article 15(4) of Indonesia's Law 4/1996 on Hak Tanggungan (the mortgage right) gives a home-loan security power of attorney at most three months to be followed by a mortgage deed. On 22 December 2017, the Minister of Agrarian Affairs and Spatial Planning signed Permen ATR/BPN No. 22 of 2017, which carves out exceptions for certain loans. Bank brochures rarely mention either rule, yet together they decide what happens to your land certificate in the weeks after you sign a KPR (home loan). What you usually hear at the signing table is a word found neither in the mortgage law nor in the two implementing regulations we read: covernote.
What a Covernote Is
A covernote is a letter from the notary/PPAT (land deed official) to the bank. Roughly, it says the deeds have been signed and the certificate paperwork is in process, and that the documents will be handed to the bank when done. On the strength of that letter, the bank releases the loan before its collateral is legally in place.
The word does not appear once in Law 4/1996, Permen ATR/BPN 22/2017 or Permen ATR/BPN 5/2020; the deadlines you can hold anyone to sit on the SKMHT and the APHT.
One practical point: the covernote is addressed to the bank, so borrowers often never get a copy. Ask for one on signing day, or within a week. Its date and document list become your reference point if things drag.
Three Documents That Move After Signing
On a new house bought from a developer, the certificate on signing day is usually not yet in the buyer's name. So the notary/PPAT runs two tracks at once.
1. Sale deed, then title transfer
The AJB (sale and purchase deed) is signed, and the PPAT registers the transfer at the land office so the certificate moves into your name. We covered the service standard and how to track it in our article on the 10-working-day title transfer standard, so we won't repeat it here.
2. SKMHT
While the title transfer is pending, the APHT can't yet be made in your name. So on signing day you sign an SKMHT (Surat Kuasa Membebankan Hak Tanggungan): a power of attorney letting the bank register the mortgage later. Article 15(1) of Law 4/1996 requires it to be a notarial or PPAT deed, and Article 15(2) makes it irrevocable unless it has been carried out or has expired.
3. APHT and the mortgage certificate
Once the certificate is in your name, the PPAT draws up the APHT (Akta Pemberian Hak Tanggungan, the mortgage deed), sends it to the land office, and BPN issues an electronic mortgage certificate (HT-el). Under Article 13(5), the mortgage right is born on the date of its land-book entry; until then the bank's security does not legally exist.

Look at row two. The Elucidation of Article 15(4) says the 3-month limit also covers certified land not yet registered to the new grantor, meaning not yet transferred, split or merged. That describes nearly every buyer of a new developer house. If no APHT follows within that window, Article 15(6) voids the SKMHT, and the bank will usually ask you to sign a new one. Ask up front who pays for the replacement deed if the delay is not your doing.
The Permen 22/2017 Exception, and Why Not to Assume It
Permen ATR/BPN 22/2017, promulgated on 17 January 2018, revoked the 1996 agrarian ministry rule and lets an SKMHT stay valid until the loan agreement ends for certain kinds of credit. For housing, Article 2(b) names two: buying or improving a core house, simple house or apartment with land of up to 200 m² and a floor area of no more than 70 m²; and serviced plots of 54 to 72 m².
The Emerald 70 house at Kingspoint has a 70 m² floor area, exactly on the line. But size isn't the only test. Article 2 also requires the home to be a core house, simple house or apartment. Whether a two-storey house in the Rp700 million range falls into that category is for the notary/PPAT and the bank to decide. Ask at signing. If the answer is no, your SKMHT runs on the 3-month limit in the table.
Count forward from signing day: title transfer, APHT and HT-el should all finish well before your SKMHT expires. If two months pass with no word on the APHT, start asking.
Why the Bank Keeps the Certificate
Many buyers are surprised that a certificate already in their name stays with the bank until the loan is paid off. Article 14(4) of Law 4/1996 returns the endorsed certificate to the land holder "unless agreed otherwise". Article 11(2)(k) allows that agreement in the APHT, and in home-loan practice banks generally use it. The mortgage certificate itself goes to the bank (Art. 14(5)). You get your certificate back once the loan is repaid and the mortgage is cancelled through the roya process.
If It Drags On for Months
What you chase are the stages in the table, roughly in this order:
- Ask the notary/PPAT in writing. Ask where the file stands: is the title transfer done, has the APHT been signed, when was it sent to the land office. Ask for the file number or receipt.
- Bring in the bank. The party hurt most by collateral that doesn't exist yet is the bank, so the KPR officer usually has a way to chase its panel notary. Bring the covernote copy.
- Check the certificate status. After the transfer, certificate data can be checked through BPN's official channels. Our guide to checking electronic certificate status shows how.
- Know where it ends. Article 23(1) of Law 4/1996 says an official who breaches or neglects the 7-working-day duty to send the APHT may face administrative sanctions, from an oral warning to dismissal. The Kota Bekasi land office is a sensible first stop to ask about the file before it gets that far.
The delay isn't always the notary's, either. A developer's master certificate that hasn't been split, mismatched data or taxes not yet validated can all hold up a transfer. So make the request specific: the file's position and its number.

Is a covernote regulated by law?
No. A covernote is a notary/PPAT letter to the bank that comes from banking practice. The binding deadlines are on the SKMHT (Law 4/1996 Art. 15) and on sending the APHT (Art. 13(2)).
How long is an SKMHT valid for a new developer house?

Article 14(4) of Law 4/1996 returns the certificate to the owner unless agreed otherwise, and in practice home-loan APHTs generally contain that agreement (Art. 11(2)(k)). The certificate comes back once the loan is repaid and the roya is done.
